Practice Description

Stephen Lee has more than a decade of commercial trial, appellate and arbitration experience, concentrating in commercial contracts, insurance, securities and technology-related matters. He has a wide variety of trial experience in state and federal courts in Texas and Louisiana and before arbitration tribunals organized under the National Association of Securities Dealers, the New York Stock Exchange and the American Arbitration Association.  Mr. Lee has represented clients in complex commercial matters, including construction and project development disputes, petrochemical plant failures, insurance coverage issues arising out of CGL and boiler and machinery policies and technology disputes, both in the chemical industry and in the computer industry.

Mr. Lee also has expertise in banking-related matters, including defending fictitious payee and forgery claims, and he has assisted corporate clients in the investigation and prosecution of employee embezzlement and theft claims.  In addition to a general commercial practice, Mr. Lee has handled cases involving real property and title issues, landlord/tenant disputes, condemnation and property tax appeals.

Recent Representative Matters

  • Obtained a substantial settlement on behalf of an ethylene producer for damages and lost production arising out of an electrical failure at the producer’s facility.
  • Provided ongoing advice and counsel to resolve project delays and other construction-related problems associated with the development and construction of a multi-million dollar chemical plant renovation.
  • Arbitrated numerous securities disputes on behalf of full service brokerage firms and financial institutions, including claims involving suitability, churning, public offerings, research, broker recruitment, clearing firm responsibilities and regulatory issues.
  • Successfully defended a national securities firm against charges of corporate raiding and theft of confidential information. The plaintiff sought more than $5 million in actual damages and after six days of arbitration, the NASD panel rejected all of the plaintiff's claims.
  • Managed a large docket of first-party insurance cases involving coverage for mold and water-related events on behalf of a national insurance company, resulting in a number of successful jury trials and summary dispositions.
  • Successfully resolved a major dispute against a global software developer on behalf of a manufacturer and marketer of petrochemicals. The case involved the development, marketing and implementation of an e-commerce software applications product.
  • Obtained a significant settlement, well in excess of the face amount of the policy, in a suit against a life insurance company based on its refusal to honor a large life insurance policy.
  • Secured several multi-million dollar settlements on behalf of chemical manufacturers seeking restitution for losses sustained to plant equipment.
  • Assisted in the defense of a Wall Street investment banking firm in state court against malpractice charges stemming from a $100 million bond offering.
